Users of the Jobs180.com agree that they will only use the Website for lawful purposes within the stated context of the Jobs180.com's intended and acceptable use of the Website and this will be interpreted according to normal and customary usage, in a manner most beneficial to all parties.

Job Seekers

Jobs180.com hereby grants you a limited, terminable, non-exclusive right to access and use the Website only for your personal use seeking employment opportunities for yourself. You may send your resumé to Jobs180.com through the Website in reply to any job advertisement. This authorizes you to view and download a single copy of the material on the Website solely for your personal, noncommercial use. In such an event, your resumé will also remain active on the Website for a predetermined period and, unless you choose to delete it, it will thereafter be stored in Jobs180.com's Database at your own risk. Jobs180.com also reserves the right to edit your resumé as it sees fit. You acknowledge and agree to Jobs180.com's practice of charging Employers a fee for access to the Website, Database and to your resumé and details. You also recognize that you have no claims to any such fees received by Jobs180.com. In addition, you acknowledge and agree to Jobs180.com's practice of giving free access to your school or alma mater to the Website, Database and to your resumé and details. Furthermore, you do agree that Jobs180.com and its associated companies may use your personal data for marketing purposes.

You agree that you are solely responsible for the content of any Document you post to the Website and any consequences arising from such posting. Your use of the Website is a privilege. Jobs180.com reserves the right to suspend or terminate that privilege for any reason at any time, in its sole discretion.

As stated in the policy, your data as a job seeker will be released to employers when you apply to their job or your resumé is purchased when you fit the employment requirements. Please be advised that some employers might undertake to perform a pre-employment background check on you based on your application and/or interview. By applying for the position, you are deemed to have consented to such a pre-employment background check being undertaken with no further notice or consent required. By using this site and providing information as a registered user, you are in agreement with our privacy policy.

Your data as a job seeker will be released to your school or alma mater when the school has registered for a free access to the GATEW@Y school portal.

Jobs180.com will not be responsible or held liable in any way if any Employer or School, whether in Philippines or elsewhere, should use your personal data for any other use other than for obtaining potential employees or gaining insight about your employment profile. You accept that personal data given to Employers, Schools or other users are given entirely at your own risk.

Employers

Jobs180.com hereby grants you a limited, terminable, non-exclusive right to access and use the Website and Resumé Database only for your internal business use of seeking candidates for employment. You will be entitled to use the Website to advertise job vacancies and/or create your own web page on the Website for a predetermined period following agreement of the predetermined service. This authorizes you to view and download a single copy of the material on the Website solely for your personal use directly related to using the Website for the purpose of searching and recruiting job prospects. You may not sell, transfer or assign any products or services or your rights to any products or services (including access to the Resumé Database) provided by Jobs180.com to any third party without the express written authorization of Jobs180.com. You agree that you are solely responsible for the content of any advertisement/ web page you post to the Website and any consequences arising from such posting. Jobs180.com reserves the right to edit any advertisement or web page as it sees fit, or altogether suspend or terminate your access and use at any time if Jobs180.com determines that you are in breach of any of these Terms and Conditions.

Jobs180.com reserves the right to change the Service Fee or institute new charges or fees, as it deems appropriate. In the event that any Employer should fail to pay the Service Fee or any other fees or charges due to Jobs180.com, Jobs180.com reserves the right to suspend or terminate the Employer's web page or advertisement, without prior notice to the Employer and further, without prejudice to all other rights and remedies.

Schools

Jobs180.com hereby grants you a limited, terminable, non-exclusive right to access and use the Website and Resumé Database only for your internal use of gaining insights on the employment status of your graduates. You will be entitled to use the Website to create your own web page on the Website for a predetermined period following agreement of the predetermined service. This authorizes you to view the material on the Website solely for your personal use directly related to using the Website for the purpose of looking up on the employment profiles of your alumni. You may not sell, transfer or assign any products or services or your rights to any products or services (including access to the GATEW@Y school portal) provided by Jobs180.com to any third party without the express written authorization of Jobs180.com. You agree that you are solely responsible for the content of any web page you post to the Website and any consequences arising from such posting. Jobs180.com reserves the right to edit any web page as it sees fit, or altogether suspend or terminate your access and use at any time if Jobs180.com determines that you are in breach of any of these Terms and Conditions.

Posting

Your web pages may not contain: copyrighted material (unless you own the copyright or have the owner's permission to post the copyrighted material); trade secrets (unless you own them or have the owner's permission to post them); material that infringes on or misappropriates any other intellectual property rights, or violates the privacy or publicity rights of others; anything that is discriminatory, sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, hateful, embarrassing or offensive to another person or entity; any display or link to pornographic, indecent or sexually-explicit images or statements of any kind; files or links to make available pirated music or other pirated media; material that contains restricted or password only access pages, or hidden pages or images; link to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone; material that provides instructional information about illegal activities or other activities prohibited by these Terms and Conditions, including without limitation, making or buying illegal weapons, violating someone's privacy, or provide or create computer viruses or pirating any media, or solicit passwords or personal identifying information from other users.

You may not post jobs or content on that contain any hyperlinks, email addresses, HTML Tags, "hidden" keywords or any keywords that are irrelevant to the job or are otherwise misleading contained in a job posting.

You may not post any jobs for any competitor of Jobs180.com or post content that contains links to any site competitive with Jobs180.com.

You may not use your web pages to impersonate another person, living or dead nor post false, inaccurate or misleading information. Resumé postings must contain the accurate resumé of a living individual seeking employment on a full-time, part-time, or contractual basis on his or her own behalf.

You may not delete or revise any material posted by any other person or entity without authorization from the assigned User.

You may not post advertisements or solicitations of business including, but not limited to, multi-level marketing, franchises, club memberships, distributorships or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment by the User, including a request for payment to obtain job listings, or requires recruitment of other members, sub-distributors or sub-agents; post chain letters or pyramid schemes; or post opinions or notices, commercial or otherwise.

You may not post advertisements that request the User to pay deposits, placement fees, processing fees or any other fees similar in nature, directly or indirectly, and/or require the User to make purchases.

You may not send unsolicited mail or email, making unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to the User.

Your web pages must contain sufficient detail to convey clearly to the User the nature and requirements of the job opportunity, or your qualifications as a candidate for employment. Postings that encourage the User to "email for more details" are not permitted. Documents from any third party charging a fee or restricting complete access to all resumé information are prohibited.

Jobs180.com is under no obligation to monitor the web pages posted on the Website, but it may monitor web pages at random. Users are strongly advised to verify advertisements with an accredited government agency. Jobs180.com is not responsible or liable for any damages, loss or expense arising from or in connection with the above or any other job advertisements. Web pages found to violate the above rules may be removed at Jobs180.com's discretion.

In order to ensure a safe and effective experience for all of our customers, Jobs180.com reserves the right to limit the amount of data (including resumé views) that may be accessed by them in any given time period.

Users who violate these rules may have their access and use of the Website suspended or terminated, at Jobs180.com's discretion. Jobs180.com reserves the right to change these rules in accordance with the amendment policy in the Terms and Conditions.

Conduct

You may not respond to postings by other Users in any manner or for any purpose other than that which is expected (i.e., to apply for the job or to initiate further discussion with the candidate). Communications soliciting the employer's business by our competitors are prohibited.

Report inappropriate postings or conduct to violations@jobs180.com.

If at any time during the term of this agreement Jobs180.com comes to the understanding that you: misled Jobs180.com of your business practices and/or services, or purchased services that do not represent your precise business, Jobs180.com reserves the right to terminate this agreement.

Jobs180.com is under no obligation to monitor the conduct of its Users, but it may investigate and respond when violations are reported.

Security

Users are prohibited from violating or attempting to violate the security of the Website, including, without limitation:

Violations of system or network security may result in civil or criminal liability. Jobs180.com will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

Intellectual Property

The contents of this Website, such as text, graphics, images and other materials (the Material), are protected by copyright. You may not sell or modify the Material or reproduce, display, publicly perform, distribute, or otherwise use the Material in any way for any public or commercial purpose in connection with products or services that are not those of Jobs180.com, in any other manner that infringes Jobs180.com's intellectual property rights. This includes copying or adapting the HTML code used to generate web pages on the Website. The use of the Material on any other website or in a networked computer environment for any purpose is prohibited.

Jobs180.com acts as a portal for the online distribution and publication of User-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring content posted by Users. If notified by a User of content which allegedly does not conform to this agreement, Jobs180.com may investigate the allegation and determine in good faith and in its sole discretion whether to remove or request the removal of such content. Jobs180.com has no liability or responsibility to Users for performance or nonperformance of such activities. Jobs180.com may take any action with respect to User-submitted information that it deems necessary or appropriate, in its sole discretion.

No endorsements by Jobs180.com

Nothing on the Site shall be considered an endorsement, representation or warranty with respect to any User or third party, whether in regards to its Website, products, services, hiring, experience, employment or recruiting practices, or otherwise.

No Guaranty of Results

Jobs180.com is not an employment agency or a recruiting firm, and makes no representations or guarantees regarding the effectiveness or timeliness of the Website in meeting the employment objectives of Users. Jobs180.com does not guarantee that Documents posted by Users will result in candidates being hired or positions being filled, and is not responsible for any employment decisions, for whatever reason made, made by any User.

Warranty Disclaimers

Without prejudice to the above, the aggregate liability by Jobs180.com to any user for all claims arising from their use of Jobs180.com's services shall be limited to the amount of the existing Service Fee subscribed to and paid for by the User (if any) and operative at that time.

Jobs180.com shall in no event be liable for any damages, loss or expense including without limitation, direct, special or consequential damage or economic loss arising from or in connection with:

The Website acts as a venue for Employers to post job opportunities and candidates to post resumés and does not screen or censor the listings offered. Jobs180.com is not involved in the actual transaction between Employers and candidates. As a result, Jobs180.com has no control over the quality, safety or legality of the jobs or resumés posted, the truth or accuracy of the listings, the ability of Employers to offer job opportunities to candidates or the ability of candidates to fill job openings or any User Content and makes no representations about any jobs, resumés or User Content on the Website. Jobs180.com is not to be considered to be an employer with respect to your use of the Website and Jobs180.com shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on the Website.

In addition, that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false identities. You assume all risks associated with dealing with other users with whom you come in contact through the Website. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases may be deceptive. Jobs180.com does not warrant that any resumé, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user. Jobs180.com is not in any way to be considered to be an agent with respect to any user's use of Jobs180.com and Jobs180.com will not be responsible in any way for any decision, for whatever reason, made by any party seeking or posting jobs on Jobs180.com. Employers are solely responsible for their postings on the Website.

Jobs180.com cannot guarantee and does not promise any specific results from use of the Website. No advice or information, whether oral or written, obtained by a User from Jobs180.com shall create any warranty not expressly stated herein.

Jobs180.com and its contents are provided on an "as is" basis without any warranties of any kind, express or implied. To the fullest extent permitted by law, Jobs180.com disclaims all warranties, including but not limited to, the merchantability, title, non-infringement of third parties' rights, and fitness for particular purpose. Jobs180.com makes no warranties about the accuracy, reliability, completeness or timeliness of the contents, services, software, text, graphics and links. Without limitation on the foregoing:

Due to the nature of this Agreement, in addition to money damages, you agree that Jobs180.com will be entitled to equitable relief upon a breach of this agreement by you.

Payment of Services upon Termination of Service Agreement

If at any time during the course of this Agreement you should terminate a Service Agreement in which these Terms and Conditions have been incorporated by reference, not to include your termination in the case of breach of this Agreement or the Service Agreement by Jobs180.com, Jobs180.com shall reserve the right to receive all payments from you for the Services used by you up to termination and for fifty percent (50%) of the remaining unused portion of the Service Agreement.

Jobs180.com may contain links to third party websites. These are provided solely as a convenience to you and not in any way as an endorsement by Jobs180.com of the contents on such third party websites. If you access any linked third party websites, you do so entirely at their own risk. Jobs180.com is not responsible for the content of any third party websites linked to its Website and does not make any representations or warranties regarding the contents or accuracy of materials on such third party websites.

Amendments to this Agreement and Changes to Site

Jobs180.com may revise this Agreement at any time by updating this page. Changes will be binding on you as of the date they are posted on the Website (or as otherwise stated in the any notice of such changes). Any use of the Website will be considered acceptance by you of the then-current Terms and Conditions (including any Exhibits thereto). If at any time you find the Terms and Conditions unacceptable, you may not use the Website any longer. Any new or different terms supplied by you are specifically rejected by Jobs180.com unless Jobs180.com agrees to them in a signed writing specifically including those new or different terms. Indemnity

Should the courts find Jobs180.com accountable to losses and damages, total liability shall not exceed double the Service Fee based on the Service Agreement with the Employer. Furthermore, any action arising from these services cannot be brought against Jobs180.com after 2 years after the cause of action accrues.

Own Risk

All Users use Jobs180.com and any other websites accessed through it at entirely their own risk. All Users are responsible for their own communications and are responsible for the consequences of their posting. Jobs180.com does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other Users or endorse any opinions expressed by Users. Any reliance by Users on material posted by other Users will be at their own risk. Jobs180.com reserves the right to expel any User and prevent their further access to Jobs180.com, at any time for breaching this Agreement or violating the law and also reserves the right to remove any material which is abusive, illegal or disruptive.

Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of the applicable class, or learning material, product or service, under the terms agreed to by the provider.

User Submissions

As a User, you are solely responsible for your Account information, content, messages or other information ("User Content") that you submit, publish or display on the Website or transmit to other users. You acknowledge, consent and agree that when submitting your resumé for storage in our resumé database, your resumé is automatically searchable by employers, recruiters, hiring managers, headhunters, and human resource professionals (the "Employers") who pay for access to our resumé database. Jobs180.com is not responsible for the use made of resumés by Employers who accessed your resumé whilst it resides in our database. You acknowledge that when your resumé is displayed in our database, personal information present within your resumé (such as your email address), can be collected and used by parties other than the Employers. This may result in unsolicited messages from third parties for which Jobs180.com is not responsible. Jobs180.com will attempt to limit access to our resumé database to the Employers, but cannot guarantee that other parties will not gain access to this database. You may remove your resumé from the Website at any time, but the Employers who have gained access to our database may have retained a copy of your resumé in their own files or databases. Jobs180.com is not responsible for the retention, use or privacy of resumés or profiles in these instances.

You acknowledge, consent and agree that job search alerts will be automatically created when you register on the Website. Job search alerts will automatically email you job opportunities based on pre-selected search criteria. Your job search alerts will search daily for new open positions that match your criteria. You can choose to have those search results emailed to you on a daily, weekly or monthly basis. In addition, you may change the search criteria of your job search alert at any time. In relation to the aforementioned, you agree that Jobs180.com may use your personal information to contact you and deliver information relating to the job search alert's search results to you, or provide administrative notices or communications applicable to your use of the Website.

You acknowledge, consent and agree that Jobs180.com can disclose your resumé and contact details ("Personal Information") to prospective Employers who purchased Jobs180.com's services in order to seek qualified candidates. Jobs180.com uses data about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities made available through such job postings.

In the event that you are an Employer posting job opportunities on the Website, you acknowledge and agree that you will use the candidates' Personal Information disclosed to you by Jobs180.com pursuant to your purchase of Jobs180.com's services for recruitment purposes only and will not disseminate such Personal Information to any third party or use such Personal Information for any other purposes.

You acknowledge, consent and agree that Jobs180.com can disclose your employment details to your school or alma mater who registered for free access to the GATEW@Y school portal in order to gain insights about the employability of its alumni. Jobs180.com is not responsible for the use made of resumés by Schools who accessed your resumé whilst it resides in our database. Jobs180.com will attempt to limit access to our resumé database to the Schools, but cannot guarantee that other parties will not gain access to this database.

Notification of Claimed Copyright Infringement

If you believe that your copyrighted work has been uploaded, posted or copied to Jobs180.com and is accessible on such Website in a way that constitutes copyright infringement, please notify us at customerservice@jobs180.com with the following information:

Policy Regarding Termination Of Users And Account Holders Who Repeatedly Infringe The Copyright Or Other Intellectual Property Rights Of Others

Jobs180.com respect the intellectual property of others, and Jobs180.com asks its users, account holders and content partners to do the same. The unauthorized reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners rights. As a condition to your use of Jobs180.com, you agree not to use Jobs180.com to infringe the intellectual property rights of others in any way. Jobs180.com will terminate the accounts of any account holders, and block access to the Website of any User who repeatedly infringes copyrights, or other intellectual property rights, of others. Term and Termination

Jobs180.com Inc. reserves the right, at its sole discretion, to pursue all its legal remedies, including but not limited to deletion of your User Content from the Website and immediate termination of your registration with or ability to access the Website any/or any other services provided to you by Jobs180.com, upon breach by you of these Terms and Conditions or if Jobs180.com is unable to verify or authenticate any information you submit to the Website. Even after you are no longer a user of the Website, certain provisions of these Terms and Conditions will remain in effect.

Governing Law and Jurisdiction

Jobs180.com's contact information is listed on the Website. Jobs180.com makes no claims that the Content is appropriate or may be downloaded outside of the Philippines. Access to the Content may not be legal by certain persons or in certain countries, and such persons have no right to access or use the Website. If you access Jobs180.com from outside of the Philippines, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. This Agreement and your Service Agreement, if you have one, are governed by the internal substantive laws of the Philippines, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this Agreement or your Service Agreement shall lie exclusively with the courts in Metro Manila, Philippines. The sole relationship between You and Jobs180.com is that of independent contractors. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of all or part of a provision shall not affect the validity of the remaining parts and provisions of this Agreement, which shall remain in full force and effect. All provisions of this Agreement shall survive termination except those granting access or use to the Website, and you shall cease all your use and access thereof immediately. You may not assign or transfer your obligations under this Agreement. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided by Jobs180.com in a particular "Legal Notice," or material on particular web pages of the Website, this Agreement and your Service Agreement where applicable, constitute the entire agreement between you and Jobs180.com.
